Plain English first: Use Branana honestly and for legitimate purposes. The brand you build is yours. We're not liable beyond what you paid. Don't do anything illegal or harmful.
Acceptance
By using Branana — whether on the waitlist, in the app, or anywhere on branana.app — you agree to these terms. If you don't agree, please don't use the product.
What Branana is
Branana is a guided brand-building system that helps small business owners create a complete brand identity. It is a tool — the decisions, inputs, and outputs are yours. Branana provides structure and guidance; it does not provide professional design, legal, or business advice.
Your account
You are responsible for keeping your account credentials secure and must not share access with others. You are responsible for all activity that occurs under your account.
Payments and refunds
All purchases are one-time payments unless otherwise stated. Because Branana delivers digital content that is immediately accessible upon purchase, we do not offer refunds once you have accessed the system beyond the initial onboarding step. If you experience a technical issue that prevents access, contact hello@branana.app and we'll make it right.
Ownership of your brand outputs
The brand outputs you create using Branana — including your logo, colour palette, type choices, and brand guide — are yours. Branana does not claim any rights over the brand identity you build through the system.
You grant Branana a limited, non-exclusive right to display anonymised or consented examples of brand outputs for marketing and product demonstration purposes, unless you opt out by emailing us.
Your conduct
You must not use Branana to create brand identities that are deceptive, infringe third-party trademarks or intellectual property, or are intended for illegal purposes. We reserve the right to suspend accounts that violate these terms.
Intellectual property
The Branana product — including its design, system logic, copy, and underlying technology — is owned by Branana and protected by applicable intellectual property laws. You may not copy, reverse-engineer, or redistribute any part of the product without written permission.
Availability
We aim to keep Branana available and reliable. However, we do not guarantee uninterrupted access. We may perform maintenance or updates without notice and are not liable for losses arising from downtime.
Limitation of liability
To the maximum extent permitted by law, Branana's liability to you is limited to the amount you paid in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential losses.
Disclaimer
Branana is provided as-is. We make no guarantees that outputs will result in any particular business outcome or be free from trademark conflicts. You are responsible for verifying that your brand does not infringe the rights of others before use.
Governing law
These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of the courts of Victoria.
Changes to these terms
We may update these terms as the product evolves. We'll notify you of material changes by email. Continued use of Branana after changes are posted constitutes acceptance of the updated terms.
